The General Product Safety Regulation (GPSR) is a European Union regulation designed to ensure that all non-food products sold in the EU are safe for consumers. It came into effect on December 13, 2024.
An unsafe item is a product that can cause harm or pose a health or safety risk when used as intended. This could be due to design flaws or manufacturing defects.
Whom does the GPSR apply to?
The GPSR applies to all professional sellers, regardless of their location, who sell items on Vestiaire Collective.
The GPSR only applies to listings created on or after December 13, 2024.
Which products are covered?
The GPSR applies to all non-food consumer products, including clothing, shoes, accessories, bags, jewellery, etc., whether new, second-hand, refurbished or reconditioned.
What changes for you on Vestiaire Collective?
For products listed on or after December 13, 2024, you are now required to provide the following information in your listing description:
The product manufacturer’s name (or register trade name) and contact information (postal and electronic address at which it can be contacted)
When the manufacturer is not established in the EU, the name, postal and electronic address of the “responsible person”
Any relevant product information like model number, pictures, type, and any other product identifiers
Product safety and compliance information, like warnings and safety information, in an accessible language.
The CE marking when required by the related regulations applicable to your product.
·
Who is the “Responsible Person”?
A product is placed on the market only when an economic operator established in the EU assumes responsibility for checking that the EU declaration of conformity, CE marking, and other technical documentation related to that product are in order.
This operator serves as the primary point of contact for market surveillance authorities, cooperates with them to provide any other information to demonstrate product conformity as required, and ensures that appropriate corrective actions are taken in the event of non-compliance.
The Responsible Person can be one of the following and must be located in the EU:
The manufacturer
An importer, if the manufacturer is not established in the EU
An authorised representative of the manufacturer
A fulfilment service provider if the manufacturer, importer, and authorised representative are not based in the EU.
You can review the General Product Safety Regulation to determine if there are additional updates you may need to make for your specific shop. If you have further questions, please contact a legal professional.
What happens if you are not compliant with the GPSR?
In the absence of GPSR-related information for certain listings, these may not be visible or accessible to buyers in the European Union.
Should you frequently list non-compliant or dangerous products that do not comply with the GPSR, Vestiaire Collective reserves the right to suspend your account for a reasonable period and after issuing a prior warning.
Good to know
If an item does not function properly or is not as described in the listing but poses no health risk, it does not classify as unsafe.
